1. DECLARANT IDENTIFICATION

I, [FULL LEGAL NAME], currently residing at [STREET ADDRESS], [CITY], Alaska [ZIP CODE], being of sound mind and acting voluntarily, do hereby prepare this Personal Property Memorandum as authorized by Alaska Stat. § 13.12.513.

"I may leave a written statement or list disposing of items of tangible personal property not otherwise specifically disposed of by this Will. Any such writing shall be given effect pursuant to Alaska Stat. § 13.12.513."

3. STATUTORY AUTHORITY

This Memorandum is authorized by Alaska Stat. § 13.12.513, which provides:

Whether or not the provisions relating to holographic wills apply, a will may refer to a written statement or list to dispose of items of tangible personal property not otherwise specifically disposed of by the will, other than money. To be admissible under this section as evidence of the intended disposition, the writing must be signed by the testator and must describe the items and the devisees with reasonable certainty. The writing may be referred to as one to be in existence at the time of the testator's death; it may be prepared before or after the execution of the will; it may be altered by the testator after its preparation; and it may be a writing that does not have significance apart from its effect on the dispositions made by the will.

Property outside this Memorandum:

  • Money is expressly excluded by AS 13.12.513.
  • Real property and intangible rights are outside a writing limited to tangible personal property. Review title documents, securities, business assets, and co-owned property individually rather than assuming the list transfers the underlying rights.

Legal authority

  • Alaska Stat. § 13.12.513 (Separate writing identifying devise of certain types of tangible personal property)
  • Alaska Stat. § 13.12.502 (Execution; witnessed wills; holographic wills)

Estate planning documents decide what happens to your property, your children, and your medical care when you cannot make those decisions yourself. Wills, trusts, powers of attorney, and health care directives each serve different purposes and each have to meet state law requirements for signing, witnessing, and notarization. A document that looks fine on the page but was not executed correctly can be rejected in probate, which is exactly when it is too late to fix.
