IV. LEGAL FRAMEWORK
A. Statutory and Regulatory Basis
The O-1 nonimmigrant classification is available under INA § 101(a)(15)(O)(i), 8 U.S.C. § 1101(a)(15)(O)(i), to:
-
O-1A: An alien who has extraordinary ability in the sciences, education, business, or athletics, which has been demonstrated by sustained national or international acclaim, and who is coming temporarily to the United States to continue work in the area of extraordinary ability; or
-
O-1B (Arts): An alien who has extraordinary ability in the arts, which has been demonstrated by sustained national or international acclaim; or
-
O-1B (Motion Picture/Television): An alien who has a demonstrated record of extraordinary achievement in the motion picture or television industry and has been recognized for those achievements.
The implementing regulations are codified at 8 C.F.R. § 214.2(o).
B. Standards of Proof
O-1A Standard: "Extraordinary ability in the fields of science, education, business, or athletics" means a level of expertise indicating that the person is one of that small percentage who have risen to the very top of the field of endeavor. 8 C.F.R. § 214.2(o)(3)(ii).
O-1B (Arts) Standard: "Extraordinary ability in the field of arts" means distinction, which is defined as a high level of achievement in a field of the arts evidenced by a degree of skill and recognition substantially above that ordinarily encountered. 8 C.F.R. § 214.2(o)(3)(ii).
O-1B (MPTV) Standard: "Extraordinary achievement" with respect to the motion picture or television industry means a very high level of accomplishment evidenced by a degree of skill and recognition significantly above that ordinarily encountered. 8 C.F.R. § 214.2(o)(3)(ii).
Practitioner Note: The O-1A standard is the same as the EB-1A standard ("top of the field"). The O-1B (Arts) standard of "distinction" is lower than the O-1A standard. The O-1B (MPTV) standard falls between the two.
C. Petitioner Requirements
The O-1 petition must be filed by a U.S. employer or a U.S. agent. 8 C.F.R. § 214.2(o)(2)(i). Unlike the EB-1A, the Beneficiary cannot self-petition.
- U.S. Employer: A person, firm, corporation, contractor, or other association or organization in the United States that employs the Beneficiary and has an employer-employee relationship.
- U.S. Agent: A U.S. agent may file the petition when the Beneficiary will work for multiple employers, when the Beneficiary is self-employed, or when the Beneficiary uses an agent to arrange short-term employment. 8 C.F.R. § 214.2(o)(2)(iv).
2025-2026 Policy Update: USCIS has confirmed that beneficiary-owned companies (corporations or LLCs) may petition for their owners, provided proper oversight structures exist, such as a board of directors with genuine supervisory authority. See USCIS Policy Manual, Vol. 2, Part M.
