12. PRACTITIONER NOTES — OKLAHOMA
Statutory Framework
- 12 O.S. § 2005.2(A) requires every party to file an entry of appearance when no other pleading has been previously filed by that counsel, including the attorney's name, signature, party represented, mailing address, telephone, fax, OBA number, and firm name.
- 12 O.S. § 2005.2(B) requires out-of-state counsel to comply with 5 O.S. App. 1, Art. 2, § 5, including filing a sworn affidavit and associating local Oklahoma counsel.
- 12 O.S. § 2005.2(C) governs withdrawal: an attorney may withdraw by filing a notice and serving the client and all parties if another attorney simultaneously enters an appearance; otherwise, leave of court is required.
Judicial Districts and County Considerations
- Oklahoma has 26 judicial districts covering all 77 counties.
- Each judicial district may have supplemental local rules governing appearance practices.
- Tulsa County (14th Judicial District) and Oklahoma County (7th Judicial District) have the highest case volumes and may have additional administrative orders regarding e-filing and appearances.
Key Practice Points
-
Mandatory E-Filing: E-filing is mandatory in all Oklahoma district courts for civil cases. Paper filings are generally not accepted absent a court order or recognized exemption.
-
Address of Record: The address provided in the entry of appearance becomes the address of record under 12 O.S. § 2005.2(D). Failure to update this address may result in missed service.
-
Simultaneous Filing: The entry of appearance must be filed no later than the first filing of any pleading or paper in the case by that counsel (12 O.S. § 2005.2(A)).
-
Withdrawal Requirements: Counsel cannot withdraw without leave of court unless substitute counsel simultaneously enters an appearance. The withdrawing attorney must serve the client by certified mail with notice of withdrawal per 12 O.S. § 2005.2(C).
-
Pro Hac Vice Limitations: Out-of-state attorneys must always associate local Oklahoma counsel. The OBA may limit the number of pro hac vice appearances per attorney per year.
-
District Court Rule 4: Withdrawal of counsel in Oklahoma district courts is also governed by District Court Rule 4, which requires advance notice to the client and opposing counsel.
-
Appearance Fees: Some counties charge a separate appearance fee or technology surcharge. Confirm the current fee schedule with the county clerk before filing.
-
Service Lists: Maintain an accurate service list from the time of your first appearance. Oklahoma courts require service on all parties of record for every subsequent filing.
Common Errors to Avoid
- Filing the entry of appearance without including all information required by 12 O.S. § 2005.2(A) (name, signature, party represented, address, phone, fax, OBA number, firm)
- Failing to associate local counsel when appearing pro hac vice
- Neglecting to update the address of record when office location changes
- Attempting to withdraw without court leave when no substitute counsel has entered an appearance

All filings must be reviewed and approved by a licensed Oklahoma attorney before submission to any court. Verify all statutory citations and local court rules before use, as rules and fees may change.
About This Template
These are the filings that drive a lawsuit through the system: complaints, answers, motions, briefs, discovery requests and responses, and post-judgment papers. Each has its own format requirements under federal and state procedural rules, and each has a deadline that cannot be missed without consequences. Clean, procedurally correct filings move a case forward; sloppy ones invite motions to strike, amended responses, and avoidable delays.
Important Notice
This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
