14. NEVADA PRACTITIONER NOTES
Court Structure
- Nevada's District Courts are organized into judicial districts; the Eighth Judicial District (Clark County) and Second Judicial District (Washoe County) handle the vast majority of civil cases
- The Justice Courts handle civil matters up to $15,000
- The Eighth Judicial District includes specialized departments: Business Court (EDCR 1.61), Complex Litigation, Short Trial Program, and Settlement Conference programs
Key Distinctions: Clark County vs. Washoe County
- Clark County (Eighth JD): Mandatory e-filing through Odyssey; EDCR governs procedures; Business Court available for commercial disputes; specific Document Codes required
- Washoe County (Second JD): E-filing through the Second JD's system; SJDCR supplements statewide rules; check for department-specific standing orders
- Rural Districts: May have different e-filing availability; confirm with the local clerk. Paper filing may still be accepted or required in some rural courts.
Withdrawal of Appearance
- Eighth Judicial District (EDCR 7.40): An attorney may not withdraw from a case without court approval. A Motion to Withdraw must be filed setting forth the reasons for withdrawal and the client's current contact information.
- Statewide (NRCP): Withdrawal requires compliance with applicable rules of professional conduct and court approval.
- Plan substitution filings in advance; coordinate with incoming counsel and the client.
Special vs. General Appearance
- Nevada recognizes the distinction between special and general appearances
- A special appearance may be made to contest personal jurisdiction or service without submitting to the court's jurisdiction
