14. NEBRASKA PRACTITIONER NOTES
Court Structure
- Nebraska's trial courts consist of District Courts (general jurisdiction), County Courts (limited jurisdiction), and Separate Juvenile Courts
- The state is divided into 12 judicial districts covering 93 counties
- District Courts have original jurisdiction over civil matters where the amount in controversy exceeds county court limits
Key Filing Rules
- Mandatory E-Filing (§ 2-202): All Nebraska attorneys must file electronically through the JUSTICE system in all trial and appellate courts, unless specifically exempted.
- Appearance of Counsel (§ 2-204): An attorney's first filing must be accompanied by a notice of appearance. Oral appearances must be followed by a written entry of appearance by the close of the next business day.
- Electronic Notice (§ 2-208): Court documents and filings are served on registered users through the JUSTICE system's electronic notice. Service is deemed complete upon transmission.
Withdrawal of Appearance (§ 6-1510)
- An attorney seeking to withdraw must obtain court approval unless the client consents and substitute counsel has entered an appearance
- File a Motion to Withdraw as Counsel with the court
- The motion must include the client's current contact information and mailing address
- The court will typically require proof that the client has been notified of the withdrawal and given adequate time to retain new counsel
- In limited scope representations under § 6-1507, withdrawal procedures may be simplified if the limited purpose has been completed
Common Pitfalls
- Failing to accompany the first filing with a Notice of Appearance (§ 2-204 requirement)
- Not filing a written entry of appearance by close of next business day after an oral appearance
- Neglecting to register in the JUSTICE system before the filing deadline
- Not checking whether the specific county requires an appearance fee
- Failing to update contact information in the JUSTICE system, resulting in missed electronic notice
- Assuming all districts have identical local rules; some districts have supplemental local requirements
Distinction from Federal Practice
- This template is for Nebraska state courts only
- Federal appearances in the District of Nebraska require separate procedures under the Federal Rules of Civil Procedure and local federal rules
- The CM/ECF system (PACER) is used for federal filings, not the JUSTICE system
This template is designed for use in Nebraska state district courts. Always verify current rules, fees, and local practices with the applicable county clerk before filing.
About This Template
These are the filings that drive a lawsuit through the system: complaints, answers, motions, briefs, discovery requests and responses, and post-judgment papers. Each has its own format requirements under federal and state procedural rules, and each has a deadline that cannot be missed without consequences. Clean, procedurally correct filings move a case forward; sloppy ones invite motions to strike, amended responses, and avoidable delays.
Important Notice
This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
