PRACTITIONER NOTES AND GUIDANCE

Arizona Court Structure

Arizona Superior Court is the court of general jurisdiction in each of Arizona's 15 counties. Justice Courts and Municipal Courts handle limited civil matters.

2025 Arizona Rule Amendments

Effective January 1, 2025, the Arizona Rules of Civil Procedure were amended. Key changes include:
- New Rule 8(j): Requires disclosure if a party's pursuit or defense of a lawsuit is subject to a litigation funding agreement (effective January 1, 2026).
- Various procedural amendments from the August 26, 2025 Rules Agenda.
- Practitioners should review the Arizona Supreme Court website for the most current rules.

Maricopa County Local Rules

• E-Filing: Mandatory in most civil cases.
• Case Assignment: Cases are assigned to a specific judicial officer at filing.
• Courtesy Copies: Check individual judge's requirements for courtesy copies.
• Scheduling Orders: An initial scheduling conference is typically set shortly after all parties have appeared.

Pima County Local Rules

• E-Filing: Mandatory in most civil cases.
• Case Management: Pima County may have different case management tracks than Maricopa.
• Check local rules at the Pima County Superior Court website.

Appearance vs. Answer Deadlines

• Filing a Notice of Appearance does NOT extend the deadline to file a responsive pleading.
• Under Ariz. R. Civ. P. 12(a)(1), the defendant must serve a responsive pleading within 20 days after service of the summons and complaint (or 30 days if the Arizona Rules of Civil Procedure Rule 4 waiver of service applies).
• Confirm all deadlines immediately upon entering your appearance.

Limited Scope Representation

• Arizona permits limited scope representation under ER 1.2(c) of the Arizona Rules of Professional Conduct.
• When filing a limited appearance, clearly specify the scope in the notice.
• File a Notice of Completion when the limited scope representation concludes.
• The client resumes pro se status (or obtains new counsel) after termination of limited scope.

Withdrawal of Counsel

• Withdrawal requires compliance with ER 1.16 of the Arizona Rules of Professional Conduct.
• An attorney must obtain leave of court to withdraw if withdrawal would prejudice the client.
• A motion to withdraw must typically include: (1) the reason for withdrawal (without disclosing confidences); (2) notice to the client; (3) upcoming deadlines and hearing dates; and (4) the client's current contact information.

1. Bar Number Requirement: Include your State Bar of Arizona number on all filings pursuant to Rule 10.
2. E-Filing Account: Register with AZTurboCourt (https://dss.turbocourt.com) before your first filing in Maricopa or Pima County.
3. Filing Deadline: Documents filed through AZTurboCourt before 11:59 PM Arizona Time are deemed filed that day.
4. Government Party Notice: When representing a public entity, include statutory notice information per A.R.S. § 12-821.01.
5. Initial Disclosure: Under Ariz. R. Civ. P. 26.1, initial disclosure is mandatory and must be made within the time frame set by the court's scheduling order.
6. Mandatory Arbitration: In Maricopa County, civil cases with claims of $50,000 or less are subject to mandatory court-annexed arbitration.
