5. Constitutional Protection — Statement of Rights
Declarants assert and rely upon the following protections:
a. Article XII, § 2 of the Oklahoma Constitution declares that the homestead of the family shall be, and is hereby protected from forced sale for the payment of debts, except for (i) the purchase money thereof, (ii) taxes due thereon, (iii) work and material used in constructing improvements thereon, and (iv) pre-existing liens.
b. Article XII, § 2 further provides that no mortgage, sale, or other alienation of the homestead by the owner, if a married person, shall be valid without the consent of the spouse, given in such manner as may be prescribed by law (see 16 O.S. § 4).
c. 31 O.S. § 1(A)(1) confirms the statutory homestead exemption co-extensive with the constitutional homestead.
d. 31 O.S. § 1.1 confirms that Oklahoma has opted out of the federal bankruptcy exemptions of 11 U.S.C. § 522(d) and that Oklahoma debtors must use the Oklahoma exemption scheme.
e. The Oklahoma homestead has NO DOLLAR LIMIT under state law within the acreage limits established above. The only dollar cap that may apply is the federal cap of $214,000 under 11 U.S.C. § 522(p), and only if the homestead was acquired within 1,215 days of any bankruptcy filing.
