XVI. PRACTICE TIPS FOR ALABAMA CIVIL FILINGS

Venue: Verify venue under Ala. Code § 6-3-2 et seq. before selecting the county for filing. General venue lies where the defendant resides or where the cause of action arose.

Punitive Damages: Under Ala. Code § 6-11-20, a plaintiff may not initially plead punitive damages. After the case is underway and a reasonable basis exists, the plaintiff must amend the complaint to add punitive damages. Caps apply under § 6-11-21.

Medical Malpractice: Under Ala. Code § 6-5-551, a medical malpractice complaint must be accompanied by a detailed statement of the claimant's theory of negligence and a compliance affidavit. Failure to attach this statement may result in dismissal.

Statutes of Limitation: Alabama's general statute of limitations for personal injury is two years (Ala. Code § 6-2-38). For breach of written contract, six years (Ala. Code § 6-2-34). For fraud, two years from discovery (Ala. Code § 6-2-3).
