RE: Demand for Payment of Final Wages — RCW 49.48.010 et seq.; Notice of Double-Damages Exposure under RCW 49.52.070
Dear [EMPLOYER CONTACT]:
I worked for [EMPLOYER NAME] as a [JOB TITLE] from [__/__/____] through my separation on [__/__/____]. My separation was by [☐ involuntary termination ☐ layoff ☐ resignation with [____] days' notice]. As of the date of this letter, [EMPLOYER NAME] has failed to pay all wages owed.
1. Itemized Wages Owed
| Category | Period | Hours / Units | Rate | Amount |
|---|---|---|---|---|
| Regular wages | [__/__/____] – [__/__/____] | [____] | $[______] | $[__________] |
| Overtime (>40 hrs/wk; RCW 49.46.130) | [__/__/____] – [__/__/____] | [____] | $[______] | $[__________] |
| Earned commissions | [Identify accounts] | $[__________] | ||
| Earned bonus | [Identify plan] | $[__________] | ||
| Paid-sick-leave balance (RCW 49.46.210) | [____] hrs | $[______] | $[__________] | |
| Accrued PTO (if policy-mandated) | [____] hrs | $[______] | $[__________] | |
| Unpaid tips / service charges (RCW 49.46.020) | [Identify period] | $[__________] | ||
| Unauthorized deductions to be restored | [Identify] | $[__________] | ||
| TOTAL UNPAID WAGES | $[__________] |
2. Statutory Deadline Violated
Under RCW 49.48.010 and WAC 296-126-023, my final wages were due "at the end of the established pay period" — i.e., [__/__/____]. That deadline has passed by [____] days.
3. Statutory Damages Triggered
Under RCW 49.52.070, willful failure to pay wages entitles me to:
- DOUBLE the amount of wages unlawfully withheld, as exemplary damages — i.e., an additional $[TOTAL] — for an aggregate exposure of $[2x TOTAL];
- Reasonable attorney's fees and costs, mandatory to the prevailing employee under RCW 49.52.070 and RCW 49.48.030; and
- L&I civil penalties of up to $20,000 per willful violation under RCW 49.48.083.
Willful refusal to pay wages is also a misdemeanor under RCW 49.52.050.
"Willful" under Washington law means the employer knew it owed the wages and intentionally failed to pay them. Schilling v. Radio Holdings, Inc., 136 Wn.2d 152 (1998). Mere financial difficulty is not a defense. Morgan v. Kingen, 166 Wn.2d 526 (2009).
4. Demand
I demand that [EMPLOYER NAME] tender the full sum of $[__________] (unpaid wages) plus $[__________] (double-damages exposure) — totaling $[__________] — by certified check made payable to me at the address above, on or before [__/__/____] (14 calendar days from the date of this letter).
5. Notice of Anti-Retaliation Protection
I am exercising rights protected by RCW 49.48.210 and RCW 49.46.100. Any adverse action — including, without limitation, negative references, contested unemployment-insurance claims, or interference with future employment — exposes [EMPLOYER NAME] to additional damages.
6. Preservation of Records
You are required to preserve all payroll, time, commission, bonus, sick-leave, and personnel records under RCW 49.46.070 and WAC 296-126-020 for at least 3 years (and longer where federal law requires). Spoliation will be reported to L&I and pursued as a separate cause of action.
7. Consequences of Non-Payment
If the full amount demanded is not received by [__/__/____], I will, without further notice:
- (a) File a Worker Rights Complaint (Form F700-148-000) with L&I's Employment Standards Program;
- (b) Pursue all civil remedies in Small Claims, District, or Superior Court, seeking double damages plus attorney's fees and costs;
- (c) Refer the matter for criminal prosecution under RCW 49.52.050 where the facts warrant; and
- (d) File an FLSA collective action in federal court if other employees are similarly affected.
This letter is sent in good faith to afford [EMPLOYER NAME] a final opportunity to resolve this matter.
Sincerely,
[EMPLOYEE FULL LEGAL NAME]

About This Template
Employment documents govern the relationship between a company and its workers, from offer letters and employment agreements through handbooks, performance reviews, and separations. Done right, they set clear expectations, protect against wrongful termination and discrimination claims, and give both sides a record to rely on. Done poorly, they invite lawsuits, agency complaints, and costly disputes.
