Re: Formal Demand for Immediate Payment of Final Wages — NRS Chapter 608

Dear [________________________________]:

This letter is a formal written demand for the immediate payment of all earned but unpaid wages, commissions, and other compensation owed to me under NRS Chapter 608.

Last Position Held [________________________________]
Pay Rate $[____] per ☐ hour ☐ week ☐ pay period ☐ year
Regular Pay Schedule ☐ Weekly ☐ Biweekly ☐ Semimonthly ☐ Monthly

II. Amounts Owed

Category Pay Period(s) Hours/Units Rate Amount Owed
Regular wages (final period) [____] [____] $[____] $[____]
Overtime (NRS 608.018; FLSA) [____] [____] $[____] $[____]
Commissions earned and due [____] $[____]
Bonuses earned and due [____] $[____]
Paid leave / PTO per NRS 608.0197 [____] [____] $[____] $[____]
Tips improperly withheld (NRS 608.160) [____] $[____]
Unlawful deductions to be restored (NRS 608.110) [____] $[____]
TOTAL PRINCIPAL DEMANDED $[____]

III. Statutory Basis

  1. Final-Pay Deadline (NRS 608.020 / 608.030). Because I was [☐ discharged / placed on nonworking status — wages were due immediately under NRS 608.020] [☐ resigned — wages were due no later than the earlier of the next regular payday or seven days under NRS 608.030]. The statutory deadline was [__/__/____]. No payment, or only partial payment of $[____], was tendered.

  2. Daily-Wage Continuation Penalty (NRS 608.040). "If an employer fails to pay [final] wages or compensation . . . , the wages or compensation of the employee continue at the same rate from the day the employee resigned, quit, was discharged, or was placed on a nonworking status until paid or for 30 days, whichever is less." A 3-day grace applies after discharge before penalties accrue per Labor Commissioner guidance. As of the date of this letter, [____] qualifying days have elapsed, producing waiting-time penalties of $[____] (daily wage of $[____] × [____] days, max 30 days = $[____]).

  3. Employee Wage Lien (NRS 608.050). Unpaid wages constitute a preferred lien on all property of the employer, prior to any other claims except court costs and taxes.

  4. Attorney Fees (NRS 608.140). In any action brought to recover wages, the court "shall award" reasonable attorney fees to the prevailing employee.

  5. Recordkeeping (NRS 608.115). I demand a wage statement showing all hours worked, rate, gross/net wages, and itemized deductions for each pay period from [__/__/____] through my last day worked.

IV. Demand and Deadline

I demand payment in full of $[____] in principal plus accrued NRS 608.040 penalties to date of payment, by wire, certified check, or direct deposit, delivered to the address above no later than [__/__/____] (10 days from the date of this letter). Penalties continue to accrue each day until paid, up to 30 days.

Failure to comply will result in the filing of a wage claim with the Office of the Labor Commissioner and/or a civil action under NRS 608.140 and 608.150 seeking unpaid wages, statutory penalties, attorney fees, costs, and enforcement of the NRS 608.050 lien. Note: a private suit deprives the Labor Commissioner of jurisdiction under NRS 608.135 — the forum will be selected based on response.

Sincerely,

[________________________________]

About This Template

Employment documents govern the relationship between a company and its workers, from offer letters and employment agreements through handbooks, performance reviews, and separations. Done right, they set clear expectations, protect against wrongful termination and discrimination claims, and give both sides a record to rely on. Done poorly, they invite lawsuits, agency complaints, and costly disputes.

Important Notice

This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
