3. Statutory Deadlines Applicable to My Separation

- LRD notifies the employer and may conduct an investigation, request payroll records, and attempt conciliation.
- LRD has authority to enforce NMSA §§ 50-4-1 to 50-4-12 (Wage Pay Act) and the Minimum Wage Act.
- Filing a wage claim does not waive your right to file a civil action in district court, but consult counsel about election-of-remedy implications.
- Statute of limitations: 3 years for minimum-wage claims (§ 50-4-32); 4 years for oral employment contracts (§ 37-1-4); 6 years for written contracts (§ 37-1-3). Do not delay.
