III. Statutory Basis

Timing. Iowa Code § 91A.4 requires that, upon termination, layoff, or resignation, the employer pay all wages earned to date by the next regular payday. That payday was [__/__/____]. No payment, or only partial payment of $[____], was tendered.

Eligibility and Practical Limits
- Iowa Division of Labor accepts wage claims from current and former employees against private employers operating in Iowa.
- The Division investigates timing-of-payment, unauthorized-deduction, and unpaid-wage claims under Chapter 91A. It does not adjudicate breach-of-contract issues unrelated to wages.
- The Division's administrative process does NOT award liquidated damages, attorney fees, or punitive damages. To recover those, file a private suit in Iowa District Court under § 91A.8.
- Civil penalties under § 91A.12 are payable to the State, not the employee.
- Two-year statute of limitations applies (Iowa Code § 614.1(8)). Do not delay.
