3. Statutory Deadline Applicable to My Separation
- § 388-3(a) — Discharge: wages were due immediately at time of discharge, or no later than the next working day if the payroll office was unavailable at the time of discharge.

4. § 388-5 Disputed-Amount Notice
To the extent any portion of the amounts listed above is disputed, you remain obligated under HRS § 388-5 to pay all amounts conceded due, without conditioning payment on any release. Acceptance by me of any partial payment will not constitute a release or accord and satisfaction with respect to the disputed balance, and any release you may attempt to require as a condition of payment is null and void.
5. § 388-6 Deductions
Any deduction from final wages must be required by federal or state statute or court process, or expressly authorized in writing by me subject to the limits of § 388-6. Damage charges may be deducted only for losses attributable to my willful or intentional disregard of your interest, and not below the minimum wage. Identify and substantiate any deduction taken, or restore it.
6. § 388-10 Civil Liability
Failure to pay wages in accordance with Chapter 388 without equitable justification subjects you, under § 388-10(a), to:
- The unpaid wages;
- A sum equal to the unpaid wages as liquidated damages (i.e., total liability ≈ 2x unpaid wages);
- Reasonable attorney's fees and costs;
- A civil penalty assessed by the Director of Labor;
- Misdemeanor criminal liability for each violation; officers, agents, or persons knowingly permitting the violation are deemed employers and individually liable.
