This letter constitutes a formal written dispute of the alleged debt referenced above and a demand for complete validation pursuant to the Fair Debt Collection Practices Act, 15 U.S.C. §§ 1692 et seq., the Consumer Financial Protection Bureau's Regulation F, 12 C.F.R. Part 1006, and applicable Alabama state law.

- The specific account-level documentation showing this particular account was included in any portfolio sale or assignment
- The price paid for this specific account (or the portfolio, if bulk-purchased) - Your authorization or license to collect this debt, including any power of attorney from the current creditor.
- Proof that you are properly registered or licensed to collect debts in the State of Alabama.
C. Account History

ALABAMA STATUTE OF LIMITATIONS NOTICE: Alabama has varying statutes of limitations depending on the type of debt. Under Ala. Code § 6-2-34, actions on contracts not under seal (including most credit card agreements and open accounts) must be commenced within six (6) years. However, open accounts and actions on account stated are subject to a six (6) year limitations period under the same provision. Actions on contracts under seal are subject to a ten (10) year statute of limitations under Ala. Code § 6-2-33. Importantly, Alabama courts have held that the statute of limitations for credit card debt is generally six (6) years from the date of default/last payment. Partial payment on a time-barred debt may restart the statute of limitations under Alabama law. Consumers are advised to consult with counsel before making any payment on an aged debt.
E. Credit Reporting Verification

PART 8: ALABAMA-SPECIFIC PROTECTIONS AND NOTICES
Limited State Debt Collection Statute
Alabama does not have a comprehensive standalone state debt collection act comparable to those in California, Florida, New York, or Texas. Consumers in Alabama rely primarily on the federal FDCPA for protection against abusive, deceptive, and unfair debt collection practices. However, several Alabama statutes provide supplemental protections:
Alabama Deceptive Trade Practices Act (ADTPA) - Ala. Code § 8-19-1 et seq.
The ADTPA prohibits deceptive acts or practices in the conduct of trade or commerce, which may include certain debt collection activities. Key provisions include:
- Prohibited Practices (§ 8-19-5): Prohibits representations that goods, services, or a contract have characteristics, uses, benefits, or quantities they do not have; representing that a transaction involves rights, remedies, or obligations it does not involve.
- Private Right of Action (§ 8-19-10): Any person who suffers any ascertainable loss of money or property due to a violation may bring a civil action.
- Damages: Actual damages plus reasonable attorney's fees. The court may award treble damages for willful or knowing violations.
Alabama Mini-Code (Consumer Finance) - Ala. Code § 5-19-1 et seq.
The Alabama Mini-Code regulates consumer credit transactions and provides certain protections for consumers regarding finance charges, late fees, and collection practices related to consumer credit.
Alabama Garnishment Protections
- Under Alabama law (Ala. Code § 6-10-7), certain wages and personal property are exempt from garnishment and execution.
- The maximum amount subject to garnishment of wages is governed by both federal law (Consumer Credit Protection Act, 15 U.S.C. § 1673) and Alabama state exemptions.
- Alabama is a "head of family" state -- if the debtor is the head of a family, certain additional exemptions apply under Ala. Code § 6-10-2.
Alabama Court Filing Considerations
- Actions on debt collection claims in Alabama must be filed in the appropriate circuit or district court depending on the amount in controversy.
- Under Ala. Code § 6-3-2, actions against individuals must generally be brought in the county of the defendant's residence.

Timeliness: The 30-day validation period under § 1692g runs from the consumer's receipt of the validation notice. Send this letter promptly to avoid disputes over timing.

Alabama's Limited State Protections: Because Alabama lacks a comprehensive state debt collection act, federal FDCPA claims are the primary vehicle for consumer relief. However, creative use of the Alabama Deceptive Trade Practices Act (Ala. Code § 8-19-5) can supplement federal claims, particularly for willful violations where treble damages may be available.

Overshadowing: Under § 1692g(b), any collection activity during the 30-day validation period that overshadows or is inconsistent with the consumer's right to dispute the debt may violate the FDCPA. Document any continued collection activity during this period.

Regulation F Compliance: Since November 30, 2021, debt collectors must comply with the enhanced validation notice requirements under 12 C.F.R. § 1006.34, including the itemization date, itemization of the current amount, and consumer response information.
