PENNSYLVANIA MODIFICATION STANDARD

Under 23 Pa.C.S. § 5338, a court may modify an existing custody order upon consideration of all 16 best interest factors enumerated in 23 Pa.C.S. § 5328(a). Unlike many other states, Pennsylvania does not require a threshold showing of a "substantial change in circumstances" before the court will consider a modification petition. Instead, the court conducts a fresh best interest analysis each time modification is sought.

However, any petition for modification must be accompanied by:
