10. NEW MEXICO-SPECIFIC NOTES
- Income Shares Model: New Mexico uses the Income Shares Model under NMSA § 40-4-11.1, combining both parents' adjusted gross incomes.
- Two Worksheets: Worksheet A applies when the noncustodial parent has the child less than 35% of the time; Worksheet B applies for shared custody (35%+ each parent).
- Imputation of Income: If a parent is willfully unemployed or underemployed, income equal to earning potential is imputed. For parents without work history, the prevailing minimum wage may be used.
- Excluded Income: General assistance, public assistance benefits received by the child, and child support received for other children are excluded from gross income.
- Proportional Additional Expenses: Health insurance and work-related childcare are divided proportionally by income share.
- Modification: Either party may seek modification upon a material and substantial change in circumstances.
