10. NEW JERSEY-SPECIFIC NOTES

  • Income Shares Model: New Jersey uses the Income Shares Model under Appendix IX and IX-A, considering both parents' net incomes.
  • Two Worksheets: The Sole Parenting Worksheet (PAR <104 overnights) and Shared Parenting Worksheet (PAR 104+ overnights) produce different results.
  • Income Cap: The guidelines table covers combined net income up to $187,200/year. For higher incomes, the court supplements with discretionary amounts per N.J.S.A. 2A:34-23.
  • No Fixed Emancipation Age: New Jersey does not set a specific emancipation age. Emancipation is fact-specific, but courts generally consider age 19 as the starting presumption.
  • Written Findings Required: Any deviation from the guidelines must include written reasons and the pre-deviation amount on the worksheet or order.
  • Modification: Either party may seek modification upon a change in circumstances, including a change in income of 20% or more.
