Knowledge of the terms of the trust may not be inferred solely from the fact that a copy of all or part of the trust instrument is held by the person relying upon this Certification.

  6. Right to Request Excerpts. Pursuant to 18-B M.R.S. Section 1013(5), a recipient who wishes to verify trustee powers may require the trustee to furnish copies of those excerpts from the original trust instrument and later amendments that designate the trustee and confer upon the trustee the power to act in the pending transaction.

  7. Enforcement of Transactions. Pursuant to 18-B M.R.S. Section 1013(7), a person who in good faith enters into a transaction in reliance upon this Certification of Trust may enforce the transaction against the trust property as if the representations contained in this Certification were correct.

  8. Bad Faith Demand. Pursuant to 18-B M.R.S. Section 1013(8), a person who makes a demand for the trust instrument in addition to a certification of trust or excerpts is liable for damages if a court determines that the person did not act in good faith in demanding the trust instrument.

  9. Accuracy. All information contained in this Certification of Trust is true, correct, and complete as of the date of execution.

  10. Governing Law. The trust is governed by the laws of the State of Maine, including the Maine Uniform Trust Code, Title 18-B M.R.S.A.

SECTION 13: STATE-SPECIFIC NOTES FOR MAINE

  1. Maine Uniform Trust Code. Maine adopted the Uniform Trust Code as Title 18-B, Part 1, enacted by P.L. 2003, ch. 618, Pt. A, with an effective date of July 1, 2005 (18-B M.R.S. Section 1103). The certification of trust is codified at 18-B M.R.S. Section 1013.

  2. Taxpayer Identification Number. Section 1013 expressly includes "the trust's taxpayer identification number" as one of the categories of information that may be included in the certification (18-B M.R.S. Section 1013(1)(G)). This is a useful addition not found in every UTC-adopting jurisdiction's version.

  3. "Fewer Than All" Language. Maine's statute uses "fewer than all" rather than "less than all" when addressing co-trustee authority (18-B M.R.S. Section 1013(1)(F)), reflecting a grammatical update from some other UTC jurisdictions.

  4. Default Revocability. Under 18-B M.R.S. Section 602(1), a trust is presumed revocable unless the trust instrument expressly provides otherwise (this subsection does not apply to a trust created under an instrument executed before July 1, 2005). This is consistent with the UTC default.

  5. Real Property Recording. Maine real property records are maintained at county Registries of Deeds. When this certification is used in connection with real property, it should be recorded at the appropriate Registry of Deeds. Recording fees vary by county.

  6. Homestead Considerations. Maine has a homestead exemption (14 M.R.S. Section 4422). When trust property includes a homestead, practitioners should consider how the homestead exemption interacts with trust ownership.

  7. Maine Revenue Services. For tax purposes, Maine Revenue Services may require additional documentation regarding the trust's status and the trustee's authority, separate from this certification.

  8. Prudent Investor Standard. Maine has adopted the prudent investor rule as part of the UTC (18-B M.R.S. Section 901). Trustee investment decisions must comply with this standard.

  9. Attorney-in-Fact Distinction. This certification should not be confused with a power of attorney. If the trustee has appointed an agent under a power of attorney to act on behalf of the trust, separate documentation of that authority may be required.

  10. Annual Reporting. Under 18-B M.R.S. Section 813, the trustee has a duty to keep qualified beneficiaries reasonably informed. This certification does not satisfy that reporting obligation.
