IV. STANDARD OF REVIEW

Issue 1: [________________________________]

De novo review applies to questions of law, including constitutional issues and statutory interpretation. (Manes v. State, 2023 WY 25.)

Abuse of discretion applies to discretionary rulings, including evidentiary and sentencing decisions. The reviewing court will not disturb the district court's decision unless it exceeds the bounds of reason. (Griggs v. State, 2016 WY 16.)

Sufficiency of the evidence — the court views the evidence in the light most favorable to the State, recognizing all reasonable inferences, and determines whether any rational trier of fact could have found the essential elements beyond a reasonable doubt. (Broom v. State, 695 P.2d 640 (Wyo. 1985); Jackson v. Virginia, 443 U.S. 307 (1979).)

Plain error applies to unpreserved issues under W.R.Cr.P. 52(b). The appellant must show (1) the record clearly reflects the error, (2) the rule of law violated is clear and unequivocal, and (3) the violation adversely affected a substantial right resulting in material prejudice. (Granzer v. State, 2018 WY 16.)

  3. Notice of Appeal: Must be filed within 30 days after entry of the judgment of conviction and sentence. (Wyo. Stat. Ann. § 7-12-102.)

  4. Brief Length: Comply with W.R.A.P. 7.05 formatting and length requirements. Be careful not to waste space on immaterial facts due to page limitations.
