PART SEVEN: PRACTICE TIPS FOR DELAWARE
Strategic Considerations
-
Obtain the Prescribed Form. Delaware requires that the petition be submitted on a form prescribed by the Director of the Office of Management and Budget. Contact the OMB or the target agency to obtain this form before preparing the petition.
-
File Well Before the Meeting. Because the agency must act at its next regular meeting, and may defer if the petition is received within 5 days of a meeting, file as early as possible to avoid delays. Review the agency's published meeting schedule.
-
Understand Agency Meeting Schedules. Different Delaware agencies meet at different intervals — some monthly, some quarterly. Research the meeting frequency to plan your filing timeline appropriately.
-
Engage the Registrar of Regulations. The Registrar of Regulations, housed within the Division of Research of the General Assembly, publishes the Delaware Register of Regulations and maintains the Administrative Code. Familiarity with the Registrar's office can be helpful in tracking regulatory proceedings.
-
Build Support Before Filing. Consider gathering support from industry groups, affected individuals, and other stakeholders. Present letters of support and sign-on letters as exhibits to the petition.
-
Prepare for Public Comment. If the petition is granted, a public comment period of at least 30 days follows. Prepare your public comments and encourage supporters to participate.
-
Monitor the Delaware Register of Regulations. All proposed regulations are published in the Delaware Register of Regulations, available at https://regulations.delaware.gov. Monitor it for agency action on your petition.
-
Consider the Regulatory Flexibility Analysis. Under 29 Del. C. § 10116, agencies must prepare a regulatory flexibility analysis. Address small business impacts proactively in your petition to help the agency anticipate this requirement.
-
Document Everything. Keep detailed records of all filings, communications, and agency responses. Delaware's judicial review provisions have strict timelines for seeking court review of agency actions.
-
Know the Judicial Review Timeline. If the agency denies the petition and you seek judicial review, the petition must be filed in Superior Court within 30 days of the agency action under 29 Del. C. § 10142.

About This Template
Administrative law covers how you interact with government agencies, from filing a comment on a proposed rule to appealing a denied license or benefit. Agency processes have their own forms, deadlines, and evidence standards that are different from what courts use. Getting the paperwork wrong usually means missing a deadline or losing the right to appeal, so precision in these documents matters as much as it does in a courtroom filing.
Important Notice
This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
