6. OREGON PRACTICE NOTES
- AG cannot represent the individual. Oregon DOJ employees are statutorily barred from offering individual legal advice. The Department mediates and may bring its own action under ORS 646.632 / 646.642 (civil penalties up to $25,000 per willful violation), but a consumer who needs damages should pair the AG complaint with a private UTPA/UDCPA action.
- Public database. Both the CFPB and the Oregon DOJ publish complaint data (CFPB by company name and narrative; Oregon DOJ in a searchable database). A high complaint count is admissible at trial as a "pattern or practice" predicate, particularly under ORS 646.638(8) (elder enhancement).
- Elder enhancement. ORS 646.638(8) permits enhanced damages of up to $10,000 per violation when the victim is 65 or older. Flag age clearly on the form so the AG investigator codes it correctly.
- CID power. ORS 646.622 / 646.632 give the AG civil investigative demand authority over UTPA matters. Documents produced to the AG can later be discoverable in private litigation.
- Statutes of limitations are independent. Filing an AG/CFPB complaint does NOT toll the one-year UTPA SOL (ORS 646.638(6)) or the FDCPA's one-year SOL. Calendar both regulatory and judicial deadlines independently.
- Recordkeeping. Oregon is a one-party-consent recording state under ORS 165.540, so phone calls recorded by the consumer are generally admissible. Submit recordings as exhibits.
- Mediation. The Oregon DOJ frequently routes complaints to a mediated resolution before opening a formal investigation. A mediation outcome is not preclusive of a later civil action unless the consumer signs a release.
- Class actions. Oregon UTPA class actions under ORS 646.638(8) require "reckless or knowing" conduct (a slightly lower bar than the willfulness needed for individual statutory damages). Coordinate AG complaints with class counsel where multiple victims emerge.
