5. KANSAS PRACTICE NOTES
- No private restitution from the AG. The Kansas Attorney General investigates and prosecutes KCPA violations in the public interest. While the AG may obtain restitution to consumers as part of a settlement or judgment under K.S.A. § 50-632(b)(2) or § 50-636, an individual complaint does not entitle the consumer to AG-led recovery. Pursue private remedies under K.S.A. § 50-634 in parallel where appropriate.
- Civil penalties. K.S.A. § 50-636 authorizes civil penalties of up to $10,000 per violation in AG enforcement actions, plus an additional $10,000 per violation under K.S.A. § 50-677 if the consumer is 60 or older, disabled, a veteran, a veteran's surviving spouse, or an immediate family member of a servicemember. Identify all protected-consumer factors in Section A.2.
- Mediation program. The Kansas AG's Consumer Protection Division offers a free mediation program. Mediation is non-binding and does not toll any statute of limitations. Use mediation early; do not let it expire your claim.
- Statutes enforced by the Consumer Protection Division (per ag.ks.gov): Kansas Consumer Protection Act, Charitable Organization and Solicitations Act, Kansas False Claims Act, Kansas Roofing Registration Act, Kansas No-Call Act, Kansas Cemetery Corporations Act, and Wayne Owen Act (identity theft).
- CFPB jurisdictional limits. CFPB authority covers debt collection, credit reporting, mortgages, deposit accounts, payday/installment loans, vehicle finance, and other consumer financial products. Non-financial consumer disputes (auto sales other than financing, home improvement other than financing, charitable solicitations) belong with the Kansas AG and FTC.
- Public Complaint Database. CFPB publishes complaints (with PII scrubbed) in a public database. Plaintiff narratives can be cited later in litigation. Choose consent-to-publish carefully — it is irrevocable once posted.
- Timing. Filing a regulatory complaint does not toll the FDCPA's one-year limitations period (15 U.S.C. § 1692k(d)) or the KCPA's three-year actual-damages limitations period (K.S.A. § 60-512). Calendar private-suit deadlines independently.
- No-Call Act. Telemarketing complaints under K.S.A. § 50-670 are filed through the Kansas AG portal; the AG and consumers both have private causes of action with civil penalties up to $10,000 per violation.
