Requirements one by one
Use the signed title or Arizona's official transfer form
A.R.S. § 28-2058 requires the seller to endorse the assignment and warranty of title and deliver the title when delivering the vehicle. MVD also accepts Form 38-1306, the Arizona-only Title Transfer Bill of Sale, instead of the signed title. It is a transfer instrument, not just a generic receipt.
Owner wording changes the signatures. An OR seller needs either owner's signature; AND and AND/OR sellers need both. All ordinary transferees sign the title application under § 28-2051. Resolve liens first because an unresolved lien can stop transfer and makes the vehicle ineligible for eTitle Transfer.
Authentication depends on which transfer instrument is used
The current paper-title checklist and § 28-2058 require a signed endorsement but do not add a notary or witness. Form 38-1306 is different: its seller signature is followed by an acknowledgment block for a notary or MVD agent. The form also rejects sequential bills of sale.
The buyer files within 15 days
Sections 28-2051 and 28-2058 give the buyer 15 days. The in-person packet uses signed Form 96-0236, the signed title or Form 38-1306, any lien release, applicable emissions compliance, and fees. Base statutory charges are $4 for title and $8 for passenger registration (§ 28-2003), plus the value-based vehicle license tax and other applicable charges (§ 28-5801).
Arizona's use tax applies to property purchased from a retailer (§ 42-5155), defined as a person engaged in the business of making sales (§ 42-5151). The revenue department therefore says casual private-party sales are not taxable. Keep the bill of sale or other purchase record to show that the seller was a private party.
Seller notice and plate handling are separate
Form 46-8502 requires the Sold Notice information within 10 days. It can protect the seller from later tickets, accidents, and similar exposure, but the form expressly says the title transfer information must also be completed.
Remove the plate before delivery. Section 28-2058 then gives the seller 30 days to transfer it, surrender it to MVD or an authorized third party, or submit an affidavit that it was destroyed.
Registration controls operation, emissions, and insurance
Until MVD records the transfer, § 28-2058 requires a temporary plate, permit, or valid plate. Section 28-2153 separately bars highway operation of an unregistered vehicle.
Arizona has no general safety inspection in the ordinary transfer checklist. Emissions testing applies in the Phoenix and Tucson metropolitan areas, including some commuters, with vehicle-specific exemptions. Road operation requires Arizona liability insurance; current minimum limits are 25/50/15 (§ 28-4009).
What trips people up
- The two seller clocks differ. Sold Notice: 10 days. Plate transfer, surrender, or destruction affidavit: 30 days.
- Notary treatment depends on the document. The ordinary signed title has no added acknowledgment in the current checklist, but Form 38-1306 does.
- A Sold Notice is not a title transfer. The buyer still files within 15 days, and the seller still completes the transfer instrument.
- Late charges are tied to the facts. Form 38-1306 warns of penalty charges after 15 days; § 28-2162 specifically imposes $8 plus $4 per added month, capped at $100, when a vehicle is operated without the required fee paid.
Common questions
Do Arizona title signatures need notarization? Not for the ordinary signed paper-title route under the current checklist. If you use Form 38-1306 instead, the seller's signature is acknowledged by a notary or MVD agent.
Does the buyer pay sales tax on a private sale? Arizona's Department of Revenue says casual private-party sales are not subject to use tax. Keep documentation showing the private-party purchase.
How long does the buyer have? 15 days to apply for title. The vehicle still needs the prescribed plate or permit and registration before ordinary highway operation.
Can the buyer keep the seller's plate? No. The seller removes it and then transfers, surrenders, or documents its destruction within 30 days.
