Requirements one by one
Ceremony and witnesses
Judges, retired judges, clerk magistrates, retired clerk magistrates, and preachers authorized by the usages of their churches may conduct the ceremony (Neb. Rev. Stat. § 42-108). The parties must solemnly declare before the minister or magistrate and attending witnesses that they take each other as husband and wife; at least two witnesses must attend besides the officiant. No other ceremony form is prescribed (§ 42-109).
License and the two records
The couple must obtain a Nebraska county-clerk license before the ceremony and use it within one year of issuance (§ 42-104). The person performing the ceremony makes a return that shows the names and residences of at least two witnesses (§ 42-108). Separately, on request, the minister or magistrate gives each party a certificate under the officiant's hand stating the parties' names, ages and residences, the witnesses' names and residences, and the ceremony's time and place (§ 42-110).
Religious-society ceremony
A religious society may join its members in marriage according to its rites and customs. Its clerk or keeper of records, or its moderator or presiding person if there is no clerk or keeper, makes and transmits the marriage certificate to the county clerk (§ 42-115).
What trips people up
The 15-day clock in § 42-108 belongs to the person who performed the ceremony: the return goes to the clerk who issued the license. The clerk separately has one month after receipt to record it (§ 42-112). The return must name and give residences for at least two attending witnesses; the cited statute does not specify witness signatures on that return.
Common questions
Must a minister register with the state before the ceremony? Section 42-108 describes a preacher authorized by the usages of the preacher's church; it states no state registration step.
Can a couple receive their own marriage certificate? Yes. On request, § 42-110 directs the minister or magistrate to give a certificate to each party. This is separate from the return sent to the issuing clerk.
