Requirements one by one

Authorized solemnizers

Section 31-11-6-1 lists clergy, judges, specified local clerks and mayors, the governor and lieutenant governor, and legislators. It also names several religious communities. The mayor's authority is limited to the mayor's county; a city or town clerk's authority is limited to a county containing that city or town (§ 31-11-6-1(a)).

License and certificates

The couple presents the license to an authorized solemnizer (§ 31-11-4-13). It expires 60 days after issuance unless the marriage is solemnized within that period (§ 31-11-4-10). The license carries an original and duplicate certificate; the solemnizer completes both, gives the original to the couple, and files the duplicate with the license (§§ 31-11-4-15 to -16).

Religious routes and ceremony form

The Friends Church, German Baptists, Bahai faith, and Church of Jesus Christ of Latter Day Saints may solemnize according to their respective rules; an imam may solemnize according to Islamic rules (§ 31-11-6-1(a)). The cited sections do not prescribe general spoken vows, an attendee-witness count, a witness signature, or a separate proxy or remote ceremony procedure. The statutory certificate form asks for the solemnizer's name, signature, and official designation (§ 31-11-4-15).

What trips people up

The solemnizer sends the duplicate certificate and the license to the clerk who issued the license within 30 days after the marriage (§ 31-11-4-16(a)(3)). Giving the original certificate to the couple is a different duty under that same section. The 60-day license period runs from issuance, not from the wedding (§ 31-11-4-10).

Common questions

Can a mayor officiate anywhere in Indiana? Section 31-11-6-1(a)(3) limits a mayor to the mayor's county.

Does the couple file the certificate? The statute assigns the duplicate-certificate and license filing to the person who solemnizes the marriage (§ 31-11-4-16(a)).
