Requirements one by one
Authorized solemnizers and declaration
Idaho Code § 32-303 lists current and some retired Idaho judges and magistrates, the current or a former governor, the current lieutenant governor and mayors, current federal judges, current Idaho tribal judges, officials approved by official tribal act, and priests or ministers. Retired Idaho judges or magistrates must also meet the section's judiciary-service and retirement-benefit condition. The parties must declare in the solemnizer's presence that they take each other as husband and wife; no other ceremony form is prescribed (§ 32-304).
License, certificate and return
The chapter directs solemnization, authentication and recording under its rules (§ 32-301). Before solemnizing, the officiant must require presentation of the license and check the parties' identity and other listed facts (§ 32-302). The issued license is substantially in the prescribed form (§ 32-401). The minister or officer executes the certificate attached to that license; its wording includes the date and place and two blanks for people in whose presence the ceremony occurred (§ 32-402). A separate certificate must be given to each party on request (§ 32-306).
What trips people up
The ceremony rule in § 32-304 requires the parties' declaration before the solemnizer and states no number of attending witnesses. The return form in § 32-402 nevertheless has two presence blanks. Read the ceremony command and the form separately.
The minister or officer who solemnized the marriage must return the executed license and certificate to the recorder who issued them within 30 days (§ 32-402). The recorder's one-month period to record the return begins only when it is received (§ 32-407).
Common questions
Can an Idaho tribal official solemnize a marriage? A current judge of an Idaho Indian tribe may do so. Another tribal official needs approval by an official act of an Idaho Indian tribe (§ 32-303).
Must a couple use set wedding vows? No. Section 32-304 requires the mutual declaration described above, but no particular ceremony form.
