Who may solemnize

Alaska lists clergy and specified religious leaders, marriage commissioners and judicial officers, elected public officers, and a religious organization's established ritual as solemnization routes (Alaska Stat. § 25.05.261(a)). A presiding judge may appoint a suitable marriage commissioner if the public interest requires, defining the commissioner's territorial jurisdiction by order (§ 25.05.081). The license permits a ceremony anywhere in Alaska within three months of its date (§ 25.05.121). The officiant checks that the people presenting themselves match the license (§ 25.05.271).

Declaration, witness and certificate

No particular ceremony form is prescribed, but the parties must assent or declare in each other's presence, before the solemnizer and at least one competent witness, that they take each other in marriage (§ 25.05.301). The witness who signs must be 18 or older, communicate with both parties before or after the ceremony but before signing, and confirm each intends to marry the other. The solemnizer and witness sign the original certificate and copies; the certificate records their confirmation of intentional, voluntary marriage (§ 25.05.301).

What trips people up

The solemnizer gives each party a signed short-form certificate. The original certificate is separately filed with the local registrar within seven days after the marriage (§ 25.05.321(a)). A church or congregation may use its own short-form certificate if it contains at least the bureau form's items. The solemnizer and witness also provide printed names and contact details (§ 25.05.321(b)).

Common questions

Can a friend or relative officiate? A person can seek appointment as a marriage commissioner from the presiding judge; § 25.05.081 requires an order setting the commissioner's jurisdiction.

How many witnesses sign? The current § 25.05.301 requires one attending witness to sign with the solemnizer. That witness must be at least 18.

Does the couple file the original certificate? Section 25.05.321(a) assigns the completed original's submission to the person solemnizing the marriage.
