Requirements one by one

Opening inventory

The estate guardian files a verified inventory and appraisement within 30 days after qualifying, unless the court grants longer. It covers property known to or possessed by the guardian (§ 1154.051), and includes an attached list of claims due to the ward (§ 1154.052). The list and inventory carry the guardian's sworn affidavit (§ 1154.053).

Recurring reports

The first estate account is due within 60 days after the first anniversary of qualification, subject to extension (§ 1163.001); later accounts are annual (§ 1163.002). The account details property changes, receipts and disbursements, cash and assets (§ 1163.001). Vouchers, bank statements and other asset proof accompany it (§ 1163.003). The guardian attaches an affidavit covering the accuracy of the account and the listed tax and bond matters (§ 1163.005).

The person guardian reports once a year (§ 1163.101). The reporting period ordinarily runs for 12 months from qualification or its anniversary, and the report is due within 60 days after that period ends (§ 1163.102). The sworn report includes support receipts and disbursements and an affidavit addressing the ward's residence, visits, health, treatment, activities, supports and unmet needs (§ 1163.101). A person guardian may use the specified unsworn declaration instead of the sworn declaration or affidavit (§ 1163.1011).

Court review

The estate account is filed with the county clerk and stays on file for 10 days before the judge considers it (§ 1163.051). If disapproved, the court orders another account within the period in its order, no later than 30 days after that order (§ 1163.051). The court also approves or rejects the person report and may require another within 30 days (§ 1163.104).

What trips people up

The court may waive annual estate accounts when the estate produces negligible or fixed income; the court can require an account when the estate closes (§ 1163.006). A missing account or report can lead to a show-cause citation; after hearing, the court may order filing and, absent good cause, revoke letters or impose a fine up to $1,000 (§ 1163.151).
