Requirements one by one
Guardian's report
Minnesota Statutes § 524.5-316(a) requires a written report at least annually and whenever the court orders one. It covers the person's mental, physical and social condition; residences during the period; communication or visit restrictions and their factual basis; services and care; and whether the guardianship should continue or change scope. A copy goes to the person under guardianship and interested persons of record. The statute fixes the interval rather than a calendar due date.
Conservator's inventory and reports
Under § 524.5-419(a), a conservator files a detailed estate inventory within 60 days after appointment with an oath or affirmation of completeness and accuracy. The conservator keeps administration records available for reasonable examination under § 524.5-419(b).
Section 524.5-420(a) calls for annual estate reports unless the court directs otherwise, and also reports on resignation, removal, termination and at other court-directed times. The report lists assets under control and period receipts, disbursements, and distributions under § 524.5-420(b)-(c), with contact information under § 524.5-420(c). A copy goes to the person under conservatorship and interested persons of record.
Oversight and late filing
The court may appoint a visitor to review a guardian report under § 524.5-316(f) or a conservator report under § 524.5-420(g). If an annual report is more than 60 days beyond its required date, the court must issue a show-cause order under § 524.5-316(g) and § 524.5-420(h). Noncompliance may lead the court to remove the fiduciary or decline a later appointment under § 524.5-316(h) and § 524.5-420(j).
What trips people up
Both roles have a separate 30-day court report for the disciplinary and legal events specified in § 524.5-316(b) and § 524.5-420(d); the annual report does not replace that event report. Section 524.5-420(h) ordinarily calls for public filing of a conservator report unless the court orders otherwise. The reporting and privacy instructions for the particular case should be checked before filing health or financial details.
Common questions
Can an interested person decline copies? Yes. An interested person may tell the court in writing that they do not wish to receive copies under § 524.5-316(e) and § 524.5-420(f).
What follows a conservatorship death? Section 524.5-431(b) requires a final report and discharge petition no later than 30 days after distribution, with hearing notice to interested persons and the estate's personal representative.
Can someone challenge a report? The person under guardianship or conservatorship and an interested person of record may submit a written statement disputing the report and petition the court for relief under § 524.5-316(c) and § 524.5-420(e).
