Requirements one by one

Opening filings

Every guardian files an initial report within 60 days after letters are signed. For a guardian of the person it is an initial plan; for a guardian of property it is a verified inventory (§ 744.362). The opening plan covers medical and personal care, social services and residence (§ 744.363). The inventory is accompanied by current statements of the ward's cash assets (§ 744.365).

Two recurring clocks

The person plan normally comes due within 90 days after the last day of the letters' anniversary month and covers the coming fiscal year. A court-directed calendar-year plan is due April 1. The property account normally is due April 1 for the preceding calendar year; if the court authorizes a fiscal year, it is due on the first day of the fourth month after year end (§ 744.367).

The annual adult plan updates the ward's condition, current needs and care for the coming year. It includes a recent clinician report and addresses whether rights could be restored (§ 744.3675). The property account lists controlled-property receipts, disbursements and property on hand, with annual or year-end cash statements (§ 744.3678). Both annual report types declare the guardian's remuneration (§ 744.367).

Copies and court review

Initial and annual reports are served on an adult ward unless totally incapacitated, and on the ward's attorney as applicable. The court may direct copies of the annual report to others (§§ 744.362, 744.367). The court approves or disapproves the report and may require a revision or proof (§ 744.369). If a report is missing, the court orders filing within 15 days after service or a showing of cause (§ 744.3685).

What trips people up

The person plan and property accounting use different default due dates. Check whether the court has directed a different calendar or fiscal basis (§ 744.367). If the guardianship ends, the guardian still must file a final report; death has a separate deadline measured from service of estate letters (§ 744.527).

Section 744.3678's annual-accounting requirements do not apply if the court determines that the ward has income only from Social Security benefits and the guardian is the representative payee (§ 744.3678(5)).

Common questions

Must payment receipts be filed with each annual account? The guardian must keep payment proof for three years after discharge; the statute says those papers need not be filed but must be available for court-ordered inspection (§ 744.3678).

How recent must the clinician's examination be for the annual plan? The physician or qualifying advanced practice registered nurse must have examined the ward no more than 90 days before the reporting period begins (§ 744.3675).
