Requirements one by one
The first 90 days
The guardian's § 13.26.271 implementation report describes how the court's plan will be carried out, including housing, medical and educational needs, services and shared decision-making. The guardian consults the adult to the maximum extent possible. A conservator's separate § 13.26.505 opening filing pairs an implementation report with a complete estate inventory and an oath or affirmation of its accuracy so far as informed. Both 90-day clocks start with distribution of the appointment order.
Continuing reports
The guardian's § 13.26.276(b) report covers the adult's condition, living arrangements and opinion, capacity, services and significant actions. When the adult lives elsewhere, it lists the number and nature of contacts. It includes a financial accounting of estate property in the guardian's possession or control. Under § 13.26.510, the conservator submits a report at least yearly and accounts on resignation, removal or court direction.
What trips people up
The visitor reviews are different. Under § 13.26.276(a), a court appoints a guardian visitor every third year. Under § 13.26.515(b), the court may appoint a conservatorship visitor every third year. A conservator's § 13.26.505 opening filing goes to the protected person if locatable, at least 14 and able to understand, and to any parent or guardian with whom that person lives. Interested persons can ask to see administration records.
Common questions
Does a change in capacity require another guardian report?
Yes. Section 13.26.276(a) requires an additional report for a significant change in the adult's capacity to meet health and safety needs or protect rights. It also names court order, resignation, removal, termination and the adult's request.
When does the court review an account?
Under § 13.26.266(d), a guardian review hearing may follow when a report calls for further consideration and the hearing is in the adult's best interests. Under § 13.26.510, allowance of a conservator's intermediate or final account follows notice and hearing; the court may require a physical check of the estate.
