More on how this was screened

Every other reviewed opinion continued to apply a surviving Sinaltrainal rule while reporting Mohamad's other-grounds abrogation, or used nearby treatment language for an unrelated authority. Those lower-court history reports are not duplicated as new treatments.

Every treatment on this page is written from the citing opinion itself, with a verbatim quote, never copied from a commercial citator. A citation flagged by our screen but not shown here was read and found not to weaken this case.

452 later cases cite Sinaltrainal v. Coca-Cola Company; 147 of those citations sat close to treatment language and were flagged for reading, and all of them have been read. Citations that did not sit near treatment language were not flagged and were not read one by one, so a court that weakened this case without using any of that language would not appear here.

Abrogated

  • The Supreme Court abrogated Sinaltrainal's holding that the Torture Victim Protection Act permits liability against corporate defendants, limiting the Act to natural persons.

Mohamad v. Palestinian Authority · Supreme Court of the United States · filed

The Torture Victim Protection Act of 1991 (TVPA or Act), 106 Stat. 73, note following 28 U. S. C. § 1350, authorizes a cause of action against “[a]n individual” for acts of torture and extrajudicial killing committed under authority or color of law of any foreign nation. We hold that the term “individual” as used in the Act encompasses only natural persons. Consequently, the Act does not impose liability against organizations. ... Compare Aziz v. Alcolac, Inc., 658 F. 3d 388 (CA4 2011) (TVPA excludes corporate defendants from liability); Mohamad v. Rajoub, 634 F. 3d 604 (CADC 2011) (TVPA liability limited to natural persons); Bowoto v. Chevron Corp., 621 F. 3d 1116 (CA9 2010) (same as Aziz), with Sinaltrainal v. Coca-Cola Co., 578 F. 3d 1252, 1264, n. 13 (CA11 2009) (TVPA liability extends to corporate defendants).
