More on how this was screened

The other reviewed opinions applied Mullis positively, reported adverse history concerning another authority, or used the flagged language for a party's position or a procedural ruling.

Every treatment on this page is written from the citing opinion itself, with a verbatim quote, never copied from a commercial citator. A citation flagged by our screen but not shown here was read and found not to weaken this case.

2,180 later cases cite Mullis v. United States Bankruptcy Court for the District of Nevada; 92 of those citations sat close to treatment language and were flagged for reading, and all of them have been read. Citations that did not sit near treatment language were not flagged and were not read one by one, so a court that weakened this case without using any of that language would not appear here.

Questioned

  • The Seventh Circuit questioned both the merit of Mullis's exception to Pulliam for federal judges and its decision to express an adequate-remedy holding in immunity terms.

Scruggs v. Moellering · Seventh Circuit · filed

Mullis v. United States Bankruptcy Court, supra, 828 F.2d at 1391-94, carves an exception to Pulliam — of doubtful merit, it seems to us, but in any event inapplicable to this case — for cases where the defendant is a federal judge rather than a state one. Since the exception is based on the proposition that the plaintiff's remedy at law for an abuse of federal judicial power is always adequate, we don’t see why the Ninth Circuit cast its result in immunity terms at all.
