Two Fifth Circuit en banc opinions in 1986 rejected its allowance of fees above the statutory witness limit as taxable costs in exceptional circumstances and under the Clayton Act. Its separate guidance on calculating attorney fees and recovering necessary deposition costs continues to be applied. The two confirmed treatments are listed below. Source note: The 1983 en banc opinion at 701 F.2d 542 reinstated the 1982 panel opinion except for a change concerning interest on the fee and cost award. Later courts often cite the 1986 overruling in a history parenthetical; those opinions did not themselves overrule Copper Liquor.
30 later cases cite Copper Liquor, Inc. v. Adolph Coors Co.; 30 of those citations sat close to treatment language and were flagged for reading, and all of them have been read. Citations that did not sit near treatment language were not flagged and were not read one by one, so a court that weakened this case without using any of that language would not appear here.

That Congress did not do so in 15 U.S.C. § 15 is clear. To the extent that Copper Liquor Inc. v. Adolph Coors Co., 684 F.2d 1087 (5th Cir.1982), modified on other grounds en banc, 701 F.2d 542 (5th Cir.1983), held otherwise, it is overruled.
