Status

Overruled in part
A reviewed court has overruled part of this case’s holding. United States v. Garcia was overruled in part, but its guidance for a knowing waiver of conflict-free counsel remains in use. Flanagan v. United States ended Garcia's rule allowing an immediate appeal from a pretrial order disqualifying criminal defense counsel.
More on how this was screened

Wheat v. United States also displaced any suggestion that a defendant's conflict waiver always requires the court to accept the chosen lawyer; the Fifth Circuit expressly recognized that effect in United States v. Sanchez Guerrero. All 45 flagged citations have been read. The two confirmed treatments are listed below.

Every treatment on this page is written from the citing opinion itself, with a verbatim quote, never copied from a commercial citator. A citation flagged by our screen but not shown here was read and found not to weaken this case.

45 later cases cite United States v. Garcia; 45 of those citations sat close to treatment language and were flagged for reading, and all of them have been read. Citations that did not sit near treatment language were not flagged and were not read one by one, so a court that weakened this case without using any of that language would not appear here.

Abrogated

  • A conflict waiver no longer forces a trial court to accept a defendant's chosen lawyer.

Wheat v. United States · Supreme Court of the United States · filed

Petitioner insists that the provision of waivers by all affected defendants cures any problems created by the multiple representation. But no such flat rule can be deduced from the Sixth Amendment presumption in favor of counsel of choice.
