More on how this was screened
Lipshy Motorcars, Inc. v. Sovereign Associates, Inc. declined to follow Tipps's statement that an order granting arbitration could be appealed, calling that statement dicta that contradicted the authority Tipps cited. Tipps's separate direction to seek mandamus from denial of arbitration under the Federal Arbitration Act reflected the law at the time; Texas later authorized interlocutory appeals of those denials by statute.
79 later cases cite Jack B. Anglin Co., Inc. v. Tipps; 79 of those citations sat close to treatment language and were flagged for reading, and all of them have been read. Citations that did not sit near treatment language were not flagged and were not read one by one, so a court that weakened this case without using any of that language would not appear here.
