Status

Limited by some courts
At least one reviewed court has limited this case’s holding to narrower facts or a narrower rule. No reviewed court has overruled it. Helling v. McKinney remains authoritative for serious future harm from prison conditions, but its deliberate indifference standard was not extended to method of execution challenges. All 178 flagged citations have been read.
More on how this was screened

The Third Circuit's limitation is listed below. Other citing opinions applied Helling's rule or found its requirements unmet on the facts.

Every treatment on this page is written from the citing opinion itself, with a verbatim quote, never copied from a commercial citator. A citation flagged by our screen but not shown here was read and found not to weaken this case.

4,261 later cases cite Helling v. McKinney; 178 of those citations sat close to treatment language and were flagged for reading, and all of them have been read. Citations that did not sit near treatment language were not flagged and were not read one by one, so a court that weakened this case without using any of that language would not appear here.

  • The Third Circuit refused to extend Helling's deliberate indifference standard for prison conditions to challenges to a method of execution.

Jackson v. Danberg · Third Circuit · filed

While Baze captured some of the language in Helling and Farmer, importantly, it did not import the "deliberate indifference” language used in those cases. The fact that Baze took such pains to extract certain language from Helling and Farmer suggests that the other standards announced in those cases do not govern Eighth Amendment method-of-execution challenges.
