TWB Architects, Inc. v. The Braxton, LLC later clarified that Rye left Hannan's standard inapplicable in every case. The other reviewed opinions applied Hannan before Rye, applied it to claims outside the effective reach of the 2011 legislation, repeated the legislative or Rye treatment history, or used “called into doubt” to describe Hannan's own treatment of another authority.
570 later cases cite Hannan v. Alltel Publishing Co.; 157 of those citations sat close to treatment language and were flagged for reading, and all of them have been read. Citations that did not sit near treatment language were not flagged and were not read one by one, so a court that weakened this case without using any of that language would not appear here.
