More on how this was screened

Andrews v. MV Transportation Inc. raised that question without deciding it; later opinions continued to apply Red Cab's amount-in-controversy rules.

Every treatment on this page is written from the citing opinion itself, with a verbatim quote, never copied from a commercial citator. A citation flagged by our screen but not shown here was read and found not to weaken this case.

3,971 later cases cite Saint Paul Mercury Indemnity Co. v. Red Cab Co.; 172 of those citations sat close to treatment language and were flagged for reading, and all of them have been read. Citations that did not sit near treatment language were not flagged and were not read one by one, so a court that weakened this case without using any of that language would not appear here.

Questioned

  • The district court raised doubt about Red Cab's post-removal jurisdiction rule in light of amended remand language, leaving the issue unresolved.

Andrews v. MV Transportation Inc. · U.S. District Court for the District of Columbia · filed

The Court is also cognizant of the fact that this Circuit has not yet opined on the continued viability of St. Paul Mercury Indemnity Co. v. Red Cab Co., 303 U.S. 283 (1938), which held that “events occurring subsequent to removal which reduce the amount recoverable . . . do not oust the district court’s jurisdiction once it has attached,” id. at 293, in light of the updated text of the remand statute, 28 U.S.C. § 1447(c), which now provides that a case must be remanded if “at any time before final judgment it appears that the district court lacks subject matter jurisdiction.” § 1447(c) (emphasis added).
