Customs officers—authority to arrest, stop, and seize

Section 73102 authorizes Guam Customs officers to arrest persons violating Guam's drug-importation laws and permits them to stop and seize suspected drug importers arriving from the United States as well as from foreign countries.

United States v. Rowland · filed 2006-09-12(1)

Because Guam Customs officers are statutorily empowered to arrest individuals who “import” drugs into Guam, see 5 Guam Code Ann. § 73102(a), and because it is an act of importation to bring drugs to Guam from the United States, we hold that Guam Customs officers are statutorily authorized to stop and seize individuals they suspect of bringing drugs to Guam, even if the person arrived on a flight originating in the United States.

United States v. Wall, the opinion reports the government's argument and a prior decision's interpretation of § 73102(2), but this court expressly declines to decide the statute's application and remands for the district court to consider it in the first instance. opinion →
