III. Legal Basis

A. Federal Telephone Consumer Protection Act — 47 U.S.C. § 227

The TCPA and the FCC's rules at 47 C.F.R. § 64.1200 prohibit, among other things:

  • ☐ Autodialed or prerecorded calls/texts to a cell phone without prior express consent — 47 U.S.C. § 227(b)(1)(A)(iii)
  • ☐ Prerecorded telemarketing calls to a residential line without prior express written consent — 47 U.S.C. § 227(b)(1)(B); 47 C.F.R. § 64.1200(a)(3)
  • ☐ Telemarketing calls to a number on the National Do-Not-Call Registry — 47 C.F.R. § 64.1200(c)(2)
  • ☐ Calls to a number on Respondent's internal do-not-call list / failure to maintain such a list — 47 C.F.R. § 64.1200(d)
  • ☐ Unsolicited advertisements sent to a fax machine — 47 U.S.C. § 227(b)(1)(C)

Statutory damages. Section 227(b)(3) permits actual loss or $500 per violation, with a discretionary increase to no more than $1,500 for a willful or knowing violation. Section 227(c)(5) separately requires more than one call within a 12-month period by or on behalf of the same entity and permits actual loss or up to $500 per qualifying violation, with a discretionary increase to no more than three times that amount. The federal statute of limitations is four (4) years. 28 U.S.C. § 1658(a).

B. Kentucky Telephone Solicitation Statute — KRS 367.46951 to 367.46999

Kentucky's telephone-solicitation statute prohibits enumerated telemarketing acts and practices. KRS 367.46955. A violation of KRS 367.46951 to 367.46999 is also declared an unfair or deceptive trade practice under KRS 367.46967, with the Attorney General empowered to enforce.

For misleading caller-ID violations specifically, KRS 367.46999(4) authorizes a private civil action by "a person or class of persons" who received a call in violation of KRS 367.46955(9), for: (1) appropriate injunctive relief; (2) actual damages; (3) actual expenses including court costs and attorney's fees; and (4) punitive damages. The action may be brought in the county where the plaintiff resides or has a principal place of business.

C. Automated Calling Equipment — KRS 367.461 to 367.469

Kentucky separately regulates "automated calling equipment" used to deliver recorded messages, requiring consent and disclosures and restricting random/sequential dialing and call times (8:00 a.m.–9:00 p.m.). KRS 367.461. KRS 367.467 makes the remedies of the Consumer Protection Act applicable to violations of these provisions.

D. Kentucky Consumer Protection Act — KRS 367.170, 367.220

Unfair, false, misleading, or deceptive acts or practices in trade or commerce are unlawful under KRS 367.170 ("unfair" means "unconscionable"). A consumer who purchases or leases goods/services primarily for personal, family, or household purposes and suffers an ascertainable loss may bring a private action under KRS 367.220 to recover actual damages, equitable relief, punitive damages where appropriate, and reasonable attorney's fees and costs (KRS 367.220(3)). The KCPA limitations period is one year after AG action terminates or two years after the KRS 367.170 violation, whichever is later (KRS 367.220(5)).


IV. Demand

V. Litigation Hold / Evidence Preservation Notice

Respondent and its officers, agents, employees, vendors, and successors are directed to immediately suspend any document-destruction practice and to preserve all documents and electronically stored information ("ESI") relating to the communications, including but not limited to:

Spoliation may result in adverse-inference instructions, monetary sanctions, and independent liability.


VI. Response Deadline and Consequences

Respondent must provide a written response within fourteen (14) days of receipt, directed to undersigned counsel at the address above.

If Respondent fails to respond or to resolve this matter, Claimant will, without further notice:

  1. File suit under the TCPA, 47 U.S.C. § 227, in the U.S. District Court for the [Eastern/Western] District of Kentucky, seeking actual loss or $500 per violation (whichever is greater), with a discretionary increase up to 3× for willful or knowing violations and injunctive relief;
  2. Assert claims under KRS 367.46999(4) (caller-ID), KRS 367.467 (automated-calling-equipment/CPA remedies), and KRS 367.220 (KCPA) in the Circuit Court for [________________________________] County, Kentucky, seeking actual damages, punitive damages where appropriate, and attorney's fees;
