III. Legal Basis

A. Federal Telephone Consumer Protection Act — 47 U.S.C. § 227

The TCPA and the FCC's rules at 47 C.F.R. § 64.1200 prohibit, among other things:

  • ☐ Autodialed or prerecorded calls/texts to a cell phone without prior express consent — 47 U.S.C. § 227(b)(1)(A)(iii)
  • ☐ Prerecorded telemarketing calls to a residential line without prior express written consent — 47 U.S.C. § 227(b)(1)(B); 47 C.F.R. § 64.1200(a)(3)
  • ☐ Telemarketing calls to a number on the National Do-Not-Call Registry — 47 C.F.R. § 64.1200(c)(2)
  • ☐ Calls to a number on Respondent's internal do-not-call list / failure to maintain such a list — 47 C.F.R. § 64.1200(d)
  • ☐ Unsolicited advertisements sent to a fax machine — 47 U.S.C. § 227(b)(1)(C)

Statutory damages. Section 227(b)(3) permits actual loss or $500 per violation, with a discretionary increase to no more than $1,500 for a willful or knowing violation. Section 227(c)(5) separately requires more than one call within a 12-month period by or on behalf of the same entity and permits actual loss or up to $500 per qualifying violation, with a discretionary increase to no more than three times that amount. The federal statute of limitations is four (4) years. 28 U.S.C. § 1658(a).

B. Kansas No-Call Act / Telephone Solicitation — K.S.A. §§ 50-670, 50-670a

The Kansas No-Call Act prohibits a telephone solicitor from making unsolicited consumer telephone calls to a consumer whose number appears on the no-call list. K.S.A. § 50-670a(c). A telephone solicitor is liable for such violations under K.S.A. § 50-670a(d). K.S.A. § 50-670 sets requirements for telephone solicitations and restricts automatic dialing-announcing devices (ADAD).

Critically, K.S.A. § 50-670a(g) provides: "Any violation of this section is an unconscionable act or practice under the Kansas consumer protection act." A Kansas no-call violation therefore triggers the KCPA's private remedies.

C. Kansas Consumer Protection Act — Private Remedies — K.S.A. §§ 50-634, 50-636

Because a no-call violation is an unconscionable act under the KCPA, an aggrieved consumer may bring a private action under K.S.A. § 50-634, which authorizes:

  • Declaratory and injunctive relief regardless of damages — K.S.A. § 50-634(a);
  • Recovery of damages OR a civil penalty, whichever is greater — K.S.A. § 50-634(b); and
  • A civil penalty of up to $10,000 per violation under K.S.A. § 50-636(a).

Reasonable attorney's fees are recoverable by a prevailing consumer. K.S.A. § 50-634(e). Notice of a private action under § 50-634(b) or (c) must be given to the Kansas Attorney General. K.S.A. § 50-634(g).


IV. Demand

Within fourteen (14) days of receipt of this letter, Respondent must:

V. Litigation Hold / Evidence Preservation Notice

Respondent and its officers, agents, employees, vendors, and successors are directed to immediately suspend any document-destruction practice and to preserve all documents and electronically stored information ("ESI") relating to the communications, including but not limited to:

  • ☐ Outbound calling lists, "scrub" records, and no-call suppression files (state and national)

  • ☐ ESI metadata, audit logs, server backups, and cloud-storage data

Spoliation may result in adverse-inference instructions, monetary sanctions, and independent liability.


VI. Response Deadline and Consequences

Respondent must provide a written response within fourteen (14) days of receipt, directed to undersigned counsel at the address above.

If Respondent fails to respond or to resolve this matter, Claimant will, without further notice:

  1. File suit under the TCPA, 47 U.S.C. § 227, in the U.S. District Court for the District of Kansas, seeking actual loss or $500 per violation (whichever is greater), with a discretionary increase up to 3× for willful or knowing violations and injunctive relief;
  2. Assert claims under the Kansas No-Call Act (K.S.A. §§ 50-670, 50-670a) and KCPA (K.S.A. §§ 50-634, 50-636) in the District Court of [________________________________] County, Kansas, seeking the greater of actual damages or a civil penalty up to $10,000 per violation, plus attorney's fees, and provide AG notice under K.S.A. § 50-634(g);
