Grounds to Terminate Parental Rights / Dispense with Consent (13 Del. C. § 1103)
If the non-custodial parent will not consent, the court may terminate parental rights when it is in the child's best interest and one or more grounds exist (check any that apply):
☐ Intentional abandonment — § 1103(a)(2) (child at least 6 months old; for at least 6 consecutive months of the 12 months preceding filing, the respondent failed to communicate or visit regularly and failed to manifest ability/willingness to assume custody).
☐ Unintentional abandonment — § 1103(a)(3) (for at least 12 consecutive months of the 18 months preceding filing, failed to communicate/visit regularly, failed to pursue paternity/visitation, and failed to manifest ability/willingness to assume custody — including the stepparent-adoption ground that the respondent is not able or willing to promptly establish and maintain contact and pay reasonable support, § 1103(a)(3)b.2).
