8. LEGAL STANDARD
A. Tennessee Rule of Civil Procedure 6.02 — Enlargement of Time
Tennessee Rule of Civil Procedure 6.02 provides:
"When by these rules or by a notice given thereunder or by order of court an act is required or allowed to be done at or within a specified time, the court for cause shown may at any time in its discretion (1) order the period enlarged, if request therefor is made before the expiration of the period originally prescribed or as extended by a previous order, or (2) upon motion made after the expiration of the specified period permit the act to be done where the failure to act was the result of excusable neglect."
B. Two Standards Under Rule 6.02
The rule establishes two distinct standards depending on when the motion is filed:

This is a higher standard requiring the movant to show that the neglect was due to circumstances beyond the movant's reasonable control. See Hodges v. S.C. Toof & Co., 833 S.W.2d 896 (Tenn. 1992).
C. Limitations on Rule 6.02
Rule 6.02 expressly provides that it "may not be used to extend the time for taking any action under Rules 50.02, 59.01, 59.03, and 59.04, except to the extent and under the conditions stated in them." Practitioners must be aware of these carve-outs, as the Court lacks authority to enlarge time for post-trial motions governed by those rules.
