VIOLATION OF SECURITY DEPOSIT LAW
Under Massachusetts law, failure to return the deposit within 30 days causes you to forfeit the right to retain any portion of the security deposit (Castenholz v. Caira, 21 Mass. App. Ct. 758 (1986)).
TREBLE DAMAGES PENALTY
Pursuant to M.G.L. c. 186, § 15B(7), a tenant who is forced to litigate for the return of a deposit is entitled to three times the amount of the security deposit, plus interest and attorney's fees.
