DEMAND FOR RETURN OF SECURITY DEPOSIT
Dear [Landlord Name]:
I am writing to formally request the return of my security deposit in the amount of $[DEPOSIT AMOUNT] for the rental property located at [ADDRESS].
I vacated the premises on [DATE VACATED] and provided my forwarding address on [DATE].
LEGAL BASIS
Under the Alabama Uniform Residential Landlord and Tenant Act (Ala. Code § 35-9A-201), a landlord is required to return the security deposit, or provide an itemized list of damages and the balance of the deposit, within 60 days after termination of the tenancy and delivery of possession.
It has now been more than 60 days since I vacated the property.
FAILURE TO RETURN
To date, I have not received [the deposit / a proper itemized list of deductions].
WARNING: Under Ala. Code § 35-9A-201(f), if a landlord fails to mail a refund or accounting within the 60-day period, the landlord shall pay the tenant double the amount of the original deposit.
DEMAND
I demand that you forward the full security deposit amount of $[DEPOSIT AMOUNT] within [10] days of receipt of this letter.
If payment is not received, I reserve the right to file a claim in Small Claims Court for double the original deposit amount ($[2x AMOUNT]) plus court costs and attorney's fees.
Please make the check payable to [TENANT NAME] and mail it to the forwarding address listed above.
Sincerely,
[Signature]
