California PTO and Vacation Policy
CALIFORNIA PTO AND VACATION POLICY
Employer: [COMPANY LEGAL NAME]
Effective date: [__/__/____]
Policy owner: [HR CONTACT AND EMAIL]
California work locations covered: [LOCATIONS]
Supersedes: [PRIOR POLICY OR "NONE"]
1. Scope and purpose
This policy describes paid time off (PTO) that [COMPANY NAME] provides to eligible California employees for vacation, rest, and personal time. It applies to [ELIGIBLE EMPLOYEE GROUPS]. Sick leave and other protected absences are administered under their separate policies and applicable law. A collective-bargaining agreement or written agreement that provides a greater benefit controls to the extent applicable.
2. Accrual and eligibility
Eligible employees accrue [____] hours of PTO for each [HOUR WORKED / PAY PERIOD], beginning [START DATE / ELIGIBILITY EVENT]. The annual accrual schedule is [SCHEDULE].
Part-time schedule: [METHOD OR "SAME BENEFIT"].
Maximum balance, if any: [____] hours or [NONE].
Carryover: [RULE].
Advance use of unearned time: ☐ Permitted up to [____] hours ☐ Not permitted.
The company will maintain records of PTO earned, used, and remaining. Employees may ask [HR CONTACT] to correct a balance or explain how the balance was calculated.
3. Requesting and scheduling PTO
Employees request PTO through [SYSTEM / EMAIL] to [APPROVER] at least [____] days before a foreseeable absence when practicable. The request should state dates and hours, not private personal details. Approval depends on staffing needs, prior approvals, and consistent application of this policy. [COMPANY NAME] will respond within [____] business days. For an unexpected absence, notify [CONTACT] as soon as practicable.
PTO may be taken in increments of [____] hours, subject to applicable law. Approved time is recorded in [TIMEKEEPING SYSTEM]. Employees must record all time actually worked, including work performed during a planned PTO period.
4. Pay and holidays
PTO is paid through regular payroll at [RATE / CALCULATION METHOD]. The treatment of commissions, differentials, variable schedules, and holidays falling during PTO is [METHOD]. PTO is not exchanged for cash during employment unless [WRITTEN CASH-OUT RULE, IF PERMITTED].
5. Separation
At separation, [COMPANY NAME] will pay all vested, unused vacation or PTO that is treated as vacation under this policy at the employee's final rate, calculated under the policy's eligibility and time-served rules. This policy does not forfeit vested vacation at separation. Any payment timing is handled with the employee's final wages under applicable California law.
If the company uses separate PTO banks, HR will identify in writing which bank or portion is vacation and apply the governing rule to that balance. The final calculation is based on [BALANCE RECORD] and [RATE METHOD]. Employees should direct separation balance questions to [HR CONTACT].
6. Administration and changes
No manager may make an exception that reduces a legal minimum or an earned benefit. A proposed change to accrual, carryover, eligibility, or payout is reviewed before it takes effect. The company may issue a written location supplement that grants additional rights; HR will provide it with this policy.
Acknowledgment
I received this policy and know where to ask about my balance and the rules for my work location. This acknowledgment does not waive any earned benefit or legal right.

Employment documents govern the relationship between a company and its workers, from offer letters and employment agreements through handbooks, performance reviews, and separations. Done right, they set clear expectations, protect against wrongful termination and discrimination claims, and give both sides a record to rely on. Done poorly, they invite lawsuits, agency complaints, and costly disputes.
