4. BASIS FOR JURISDICTION AND VENUE

8. QUALIFICATION AND PRIORITY OF EXECUTOR

a. The Applicant is an Executor named in the Will, and is the person entitled to apply for and receive Letters Testamentary, having first priority to qualify under N.C. Gen. Stat. § 28A-6-1.

b. The Applicant is not disqualified to serve under N.C. Gen. Stat. § 28A-4-2 (e.g., is not under 18, not adjudged incompetent, not a convicted felon whose rights are not restored, and is otherwise qualified) and has not renounced the right to serve.

12. NOTICE / CERTIFICATE OF SERVICE

a. Notice to devisees (N.C. Gen. Stat. § 28A-2A-3): The Clerk of Superior Court is required to notify by mail all devisees whose addresses are known, designated in the Will filed for probate. The expense is a proper charge to the estate.
