8. NOMINATION AND PRIORITY OF PERSONAL REPRESENTATIVE

a. Petitioner has priority for appointment under MCL 700.3203(1)(a) as the person with priority determined by the probated will, including a person nominated by a power conferred in the will.

b. The statutory order of priority (MCL 700.3203(1)) is: (a) the person with priority under a probated will, including a person nominated by a power in a will; (b) the surviving spouse if the spouse is a devisee; (c) other devisees; (d) the surviving spouse; (e) other heirs; (f) after 42 days after death, the nominee of a creditor found suitable by the court; and (g) after 63 days after death, or if the court finds exigent circumstances, the state or county public administrator when one of the statutory conditions in MCL 700.3203(1)(g) applies.

c. ☐ Other persons with priority under MCL 700.3203(1)(b) through (e) have a prior or equal right to appointment; suitable renunciations and/or nominations (PC 567) have been or will be filed under MCL 700.3203(3). A person whose priority is determined by the probated will does not gain a nomination power merely from that priority.

9. BOND

Under MCL 700.3603, the bond rules differ between informal and formal proceedings. In a formal proceeding, the court may order bond when appointing the personal representative. If the will relieves the personal representative of bond, the court may order bond only if an interested person requests it and the court finds bond desirable. If the will requires bond, the court may dispense with bond if it determines bond is unnecessary.

Under MCL 700.3605, a person whose apparent estate interest, or a creditor whose claim, exceeds the statutory dollar amount may file a written demand for bond. MCL 700.3605 states a $30,000 base amount and requires adjustment under MCL 700.1210; confirm the adjusted amount applicable to the year of the Decedent's death before relying on this procedure.

Notice (MCL 700.3403; MCR 5.107, 5.108): A hearing on the Petition is required. The petitioner must serve the Notice of Hearing (PC 562) and copies of the Petition, the will, and the completed testimony form(s) on the interested persons. Personal service must be made at least 7 days before the hearing, service by mail must be made at least 14 days before the hearing, and electronic service under MCR 1.109(G)(6)(a) must be made at least 7 days before the hearing.
