Pet Trust Agreement Template

KEY LEGAL STATUS: As of 2016, all 50 states and the District of Columbia have enacted pet trust laws. Pet trusts are legally enforceable honored trusts — not mere "honorary trusts" — in all U.S. jurisdictions. The UTC § 408 framework provides for enforcement by a court-appointed or designated trust enforcer when the caretaker or trustee fails to comply.

IMPORTANT DISTINCTIONS: A pet trust has THREE separate roles:
1. Trustee — manages the money (may be a person or institution)
2. Caretaker — provides day-to-day care for the animal(s)
3. Trust Protector/Enforcer — ensures the trust is being administered for the animal's benefit

These roles should be held by different people to create accountability.
